Terms of Use

These terms govern your use of the IMES Benefit Evaluator and related services (the “Service”), provided by [CubeEnergies Ltd] (company number [number], registered in England & Wales at [registered address]). By creating an account or using the Service you agree to these terms.

1. The Service

The Service models the potential savings and performance of solar, battery storage, tariff choices and energy-management options for a home, based on the information you provide and third-party data (such as your energy consumption and solar-yield estimates). It also lets you design a solar array and carry that design into an evaluation.

2. Your account

• You must provide accurate information and keep your login credentials secure.
• You are responsible for activity under your account.
• You must be at least 18 and use the Service for your own property or with the owner’s permission.
• Tell us promptly if you suspect unauthorised access.

3. Acceptable use

You agree not to misuse the Service — including attempting to disrupt it, access it without authorisation, scrape it at scale, or use it unlawfully.

4. Estimates, not guarantees

The figures the Service produces are estimates for guidance only. They depend on the accuracy of the information you enter, on third-party data, on assumptions about weather, tariffs, prices and behaviour, and on future conditions that cannot be predicted. Actual savings, generation, costs and payback will vary and may differ materially from any estimate. Nothing in the Service is financial, investment, tax or professional advice, and it is not a formal quotation or an offer of supply. You should obtain your own professional advice and a written quotation before making a purchase decision.

5. Third-party data and services

The Service relies on third parties (for example your energy supplier’s data via API, mapping imagery, and solar-yield databases). We are not responsible for the accuracy, availability or content of third-party data or services, and your use of them may be subject to their own terms.

6. Intellectual property

The Service, its software, models and content are owned by CubeEnergies or its licensors. We grant you a personal, non-exclusive, non-transferable right to use the Service for its intended purpose. The data you enter remains yours; you grant us the permissions needed to operate the Service for you (see the Privacy Policy).

7. Availability

We aim to keep the Service available but provide it “as is” and may change, suspend or withdraw features without notice. We are not liable for downtime or data loss beyond our reasonable control.

8. Liability

Nothing in these terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud). Subject to that, and to the maximum extent permitted by law, we are not liable for any decision you make in reliance on an estimate, nor for indirect or consequential loss, loss of profit, or loss of anticipated savings. Our total liability arising out of the Service is limited to [£100 / the amount you paid us, if any, in the preceding 12 months].

9. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these terms.

10. Changes to these terms

We may update these terms; the “last updated” date above will change and continued use means you accept the update.

These terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction.
